Can I connect my ps5 to it and plug the hdmi cable into my monitor via the output of the capture card and then play without delay and with the 120hz that the ps5 outputs? or is that regulated to 60hz?

There is still no official answer to this question from Elgato in the FAQ. However, if you look at the specs, the 4k60 Pro is the only one listed with 240 fps pass-through @ 1080p and 144 fps in 1440p.
Bandwidth is listed as 200mbit. All this + the fact that 4k 120hz is not officially supported by hdmi 2.0 pretty clearly indicates that 4K only 60 fps passthrough is possible.
You'd have to wait for new capture cards. However, very few games will actually run at 120hz @ 4K. And the prerequisite would still be that you also have a TV that can play this accordingly (i.e. ideally also supports hdmi 2.1). With this capture card, at least 1440p @ 144hz would be possible. Unfortunately there is no information if the PS5 supports this.
Hope I could help.
