10.8V or 12V batteries are exactly the same. 3 cell Li-ion battery with a nominal voltage of 10.8V. 12V is actually a wrong specification but sounds better. I'd say it's a grey area. About the device: it comes without a battery. (you can use your 10.8 or 12V batteries).
